Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of Lullagram, a pregnancy and baby tracking application provided by Lullagram Limited, a company registered in Ireland (company number 828691, registered office 41 Coppenger Fields, Ballincrokig, Dublin Pike, Cork City, Cork, Ireland, T23 PD7H) ("we", "us", "our"). By creating an account or otherwise using Lullagram, you agree to these Terms.

Lullagram Limited took over Lullagram from its founder, Christopher O'Callaghan, on 22 October 2026. If you already had an account, a subscription or a gift pass, it carries on unchanged.

If you do not agree, do not create an account.

2. Eligibility

You must be at least 18 years old to register a Lullagram account. Lullagram is designed for parents and legal guardians to track their own babies. By creating an account, you confirm you meet this age requirement.

You must be the parent or legal guardian of any baby whose data you log in the app, or have the explicit permission of the parent/guardian to do so on their behalf (e.g. as a partner sharing a household account).

3. Your account

• You're responsible for keeping your account credentials secure
• You must provide accurate information when registering
• One person, one account. Don't share accounts (use the household sharing feature instead)
• Notify us immediately at hello@lullagram.ie if you believe your account has been accessed by someone else

4. Medical disclaimer (important)

Lullagram is a logging and information tool. It is not:

• A medical device
• A substitute for professional medical advice, diagnosis, or treatment
• A replacement for your GP, public health nurse, paediatrician, or any other healthcare provider
• An emergency service

Information shown in the app, including content in our Newborn Care guides and content summarised from HSE.ie, is provided for general guidance only. It may not apply to your baby's specific situation.

You agree that:

• Decisions about your baby's health are yours alone, made in consultation with qualified healthcare providers
• You will not rely on Lullagram, or on information shown in Lullagram, in place of qualified medical advice
• In a medical emergency, you will call 112 or 999, not consult the app
• For non-emergency health questions in Ireland, you can call HSE Live on 1800 700 700

5. Relationship with the HSE

Lullagram is an independent application. We are not affiliated with, endorsed by, partnered with, or in any way associated with the Health Service Executive (HSE), Tusla, the Department of Health, or any other Irish government body or agency.

Where Lullagram links to or summarises HSE content, this is purely informational. HSE has not reviewed, approved, or sponsored Lullagram.

6. Subscriptions and payments

Trying for a baby and pregnancy are free. The baby tracker has a free week (a month with a friend's code), then needs a subscription. You can subscribe in two ways:

• In the Android app, through Google Play. Google sells and manages the subscription under Google Play's payment terms. You cancel in your Google Play account settings, and refunds are handled by Google under Google Play's refund policy.
• By card on iPhone or a computer, through our payment provider Stripe. You cancel in the app under Manage subscription, and you keep access until the end of the period you have paid for.

Your right to change your mind (card payments): if you subscribe by card or buy a gift pass, you can withdraw within 14 days of the day you subscribe or buy, without giving a reason. Email hello@lullagram.ie within those 14 days: we will end the subscription or gift pass and refund any payment you have made in full, within 14 days of hearing from you.

• Pricing and billing periods are shown in the app before you subscribe
• Free trials, if offered, convert to paid subscriptions automatically unless you cancel before the trial ends
• If your payment fails, we may restrict access to paid features until payment is resolved
• Friend referrals: a new household that uses a friend's code within 14 days of signing up gets 30 days free instead of 7. The free period starts at sign-up, or, if you start with trying for a baby or pregnancy, when you add your baby. One code per household, only before any subscription starts, with no cash value. We may change or end the referral offer for new referrals at any time

7. Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Try to access other users' accounts or data
• Reverse-engineer, decompile, or attempt to extract the source code
• Use automated tools (bots, scrapers) to interact with the service
• Upload content that is offensive, defamatory, or infringes anyone's rights
• Resell, sub-license, or commercially exploit access to the app

8. Your data

You retain ownership of all data you enter into Lullagram. By using the app, you grant us a limited licence to store and display that data back to you (and to other members of your household if you've shared access). This licence ends when you delete the data or your account.

How we handle your data is set out in our Privacy Policy, which forms part of these Terms.

9. Service availability

We aim to keep Lullagram running reliably but we don't guarantee uninterrupted service. The app may be unavailable from time to time due to maintenance, infrastructure issues, or for reasons outside our control. The offline mode allows you to continue logging entries which sync when connectivity returns.

10. Liability

To the maximum extent permitted by law:

• Lullagram and its creator accept no liability for outcomes arising from use of the app or reliance on any information displayed in it, including but not limited to health outcomes for your baby
• We accept no liability for indirect, consequential, or incidental losses (lost time, distress, lost opportunities, etc.)
• Our total aggregate liability for any direct losses arising from your use of the app, in any 12-month period, is limited to the greater of: (a) the amount you paid us in subscription fees during that period, or (b) €50
• Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded under Irish consumer protection law

11. Termination

You can delete your account and end your use of Lullagram at any time via the "Delete account" option in the app, or by emailing us.

We may suspend or terminate your account if you breach these Terms, particularly the acceptable use section. We'll generally give you notice and an opportunity to address the issue, unless the breach is serious enough to require immediate action.

12. Changes to the app or these Terms

We may update the app, change features, or change pricing. Material changes to the Terms or pricing will be notified to you by email and inside the app, and you'll have an opportunity to accept the new Terms or close your account.

Continued use of the app after a Terms update means you accept the new Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of Ireland. Any dispute arising from these Terms or your use of the app is subject to the exclusive jurisdiction of the Irish courts. EU consumers may also rely on mandatory consumer protection provisions of their home country.
